About Us

Aiquire Inc. (collectively “We, our, us”) offers users access to and use of the Imagine Studio: AI Avatar generator application (as defined below), including the ability to purchase and/ or acquire personalized Avatars through the Imagine Studio: AI Avatar generator application. This Privacy Policy applies to visitors of our website located at https://imaginestudio.app (the ‘Website’) who view only publicly-available content (the ‘Visitors’); and users of our Mobile App “Imagine Studio : AI Avatar generator” (the ‘App’) who download and register (the ‘User’ or ‘You’).

Our App works in the following way to allow Users to generate personalized ‘Avatars’:

1. User Signup/ Login using Device Authentication and access our App.

2. User selects the paid pack of generating Avatars(set of number of Avatars).

3. User makes the payment using device provider payment method.

4. Post payment User access our App and upload 10 to 20 photos and select the gender.

5. We train a model on the backend and generate the Avatars.

6. Once the Avatars are generated, the uploaded photos, are deleted permanently

from our servers,

7. We will save the Avatars on our servers for User to access it on the App at any time.

8. We do not use your personal information to generally train and/or create our separate artificial

intelligence/ products.

To facilitate Avatars, we ask you about your gender. This information is used solely to generate the Avatars in accordance with the indicated gender. We do our best to generate Avatars however, it is still possible that you may encounter content that you may see as inappropriate for you.

Why we collect personal information

We use your information other than photos for the following purposes:

a) To carry out our obligations and enforce our rights arising from any contracts entered into between you and us in relation to the App (e.g., the Terms of Use).

b) To provide you with support and to respond to your inquiries. If you share your personal information (including your name and contact information to ask a question about our services, we will use that personal information to investigate your concerns, respond to your inquiries and to monitor.

c) To monitor aggregated metrics such as total number of users, traffic, and demographic patterns. It is our legitimate interest to make aggregated analytics of our audience as it helps us understand our business metrics and improve

our product.

d) To provide, improve, test, and monitor the effectiveness of the App in an aggregated manner. It is our legitimate interest to make analytics of our audience as it helps us understand our product and business metrics.

e) You provide your gender identification when you choose to generate Avatars via the App, which is used, to generate avatars based on your particular photos. It is our contractual obligation to ensure that we provide you with the requested service. This information is deleted immediately after the Avatars are successfully generated.

f) In any other way, as described in this Privacy Policy.

We will not process your personal information in a way that is incompatible with the purposes for which it has been collected or authorized by you in accordance with this section.

For any new purpose of processing that is not compatible with any of the purposes mentioned above, we will ask for your separate explicit consent.

To the extent necessary for any of the processing purposes, we take all reasonable steps to ensure that your personal information is reliable for its intended use, accurate, complete and current. We also undertake to collect only such amount and types of your personal information that are strictly required for the purposes mentioned in this section.

How we use personal information collected/received

Information we collect may be transferred, stored, used, and/or processed as follows:

a) Contact Information

When you become a User of the App, you will be asked to provide us with certain personal information about yourself which may include your name, email address, or device ID.

b) Billing Information

In certain circumstances, to use the App Services, you may be required to provide additional information for payment processing to third party service providers. App does not store, retain, or use Billing Information which may include a name, credit card number, and expiration date, or any related information to processing payments. However, information like subscription id and other payment verification details may be shared with us by the service providers.

c) User Activity Information

In an ongoing effort to operate the App and the App Services, improve it to deliver better service and understand how you use the App and what you like and dislike the most we automatically collect information about your use of the App and your in-app purchases, including frequency of use, areas and features of the App that you access and your engagement with particular features.

d) Service Information

In connection with providing the App Services to User, App may collect device connection information about your mobile device and internet connection, including your IP address, the device’s unique device identifier, operating system, and mobile network information. App may utilize this information to support the App Services, including maintaining platform security and availability, for fraud detection, and for resolving ad serving errors.

How long we keep personal information for

a) We will never retain personal information for longer than it is necessary for the purposes we need to use it for. Normally we will retain your personal information, other than your photos or Avatars, until you delete your account or request us to delete your information. Uninstallation of App does not imply the deletion of your account and your information.

b) We may also retain personal information for as long as required by law or regulation or instruction of a relevant accreditation body.

c) Generally, in respect of personal information collected in the context of usage of App, we will retain such personal information for the duration as long as necessary or a period of up to 12 months after the App is uninstalled, in case such personal information is required for the exercise or defence of a legal claim during this period.

d) In event of User’s request to delete, we remove personal information immediately except what is required by law or regulation or regulation or instruction of a relevant accreditation body.

We do not use photos or Avatars for

a) identification any individual User.

b) authentication, advertising, or marketing purposes, or to otherwise target a User in a similar manner.

c) building a User profile, or otherwise attempt, facilitate, or encourage third parties to identify anonymous Users or reconstruct User profiles based on your photos or Avatars provided by you.

Sharing and disclosure of personal information

We may share your information at your direction or as described below at the time of sharing.

a) Third-Part Service Providers

App may share your information with Third-Party Service Providers that support us in delivering the App Services to our Users. We may disclose personal information to our third-party payment processors who perform services for us in connection with the App, or to complete or confirm a transaction or series of transactions that you conduct with us.

b) Comply with the Law

App may disclose your information to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required to do so by law, regulation, or legal process.

c) Business Transfers

If App undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all our assets, including your personal information. Where do we store personal information

Our servers are located in USA. If you are located outside of USA, please be aware that any information provided to us, including personal information, will be transferred from your country of origin to USA, to enable us to provide App Services to you. Your decision to provide information to us, or to allow us to collect such information through our Website or App Services, constitutes your consent to this information transfer. If you do not consent to this information transfer, do not submit personal information to App. If you would like to access, correct, amend, delete, or export any personal information that you have shared with app you may contact us using the information below.

How We Protect Personal Information

App uses reasonable technical and organizational security measures to safeguard personal information that is submitted to us voluntarily through our Website or the App Services or collected through interactions with the App Services. However, no security measures are perfect or impenetrable. We cannot control the actions of third parties with whom you elect to share your personal information and we cannot accept liability for improper access to that information. We cannot guarantee that only authorized persons will view your personal information. We cannot ensure that information you share on our website and/or through App Services will not become publicly available.

In the event that your information is compromised, we will notify you and competent Supervisory Authority/(ies) within 72 hours by e-mail with information about the extent of the breach, affected information, any impact on the service and App’s action plan for measures to secure the information and limit any possible detrimental effect on the individuals.

Please note that we may ask you to verify your identity before responding to such requests. If you make a request, we will try our best to respond to you as soon as possible.

The App is not intended for children under 18 years of age. You must be at least 18 years old to use the App and/or the App Services.
